SelcorSMS Terms of Service

These Terms of Service (“Terms”) govern your use of the SelcorSMS platform, a product of Selcor LLC (“Selcor,” “we,” “us,” or “our”).
By accessing or using SelcorSMS, you agree to these Terms.
1. Service Overview
SelcorSMS provides an SMS communication platform that allows authorized users (“Clients”) to send text messages to contacts who have explicitly opted in to receive such messages.
The service may be used for:
Informational updates
Event and appointment reminders
Political or advocacy campaign communications
Emergency and service alerts
Use of SelcorSMS is subject to all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and carrier guidelines.
2. Account Responsibilities
You must provide accurate and complete information when registering.
You are responsible for maintaining the security of your account and API credentials.
You agree not to share credentials with unauthorized users.
Clients are solely responsible for the content of messages sent through their accounts.
3. Acceptable Use Policy
You agree not to use SelcorSMS for:
Sending unsolicited or spam messages
Misleading, fraudulent, or deceptive content
Pornographic, violent, or otherwise prohibited (“SHAFT”) content
Harassment, hate speech, or threats
Any illegal or unethical activity
Selcor may suspend or terminate any account violating these standards without notice.
4. Consent & Compliance
All message recipients must have provided express written consent to receive SMS messages from the sender.
Clients must:
Present clear opt-in language and frequency disclosures
Retain proof of consent (timestamp, IP, consent text)
Include opt-out instructions (“Reply STOP to unsubscribe”) in each message
Immediately honor opt-out and HELP requests
SelcorSMS automatically processes STOP/HELP replies at the brand level.
Failure to comply with carrier or legal requirements may result in account suspension or fines.
5. Fees & Billing
Clients are billed based on message volume, number provisioning, and optional add-ons.
Usage fees are non-refundable except where required by law.
Selcor reserves the right to adjust pricing with 30 days’ notice.
6. Data Ownership
Clients retain ownership of their contact lists and message content.
Selcor acts as a data processor, transmitting and storing information only as necessary to provide services and maintain compliance.
Selcor may analyze aggregated, anonymized data to improve platform performance and reliability.
7. Termination
You may cancel your account at any time by contacting support@selcorllc.com.
Selcor may terminate your access immediately for:
Breach of these Terms
Violation of law or carrier rules
Security or fraud concerns
Upon termination, your access to message history and data may be disabled, though Selcor will retain consent records for compliance.
8. Limitation of Liability
Selcor LLC is not liable for:
Delivery delays or message failures beyond its control
Damages resulting from client misuse or non-compliance
Loss of profits, data, or goodwill
Total liability shall not exceed the amount paid by the client within the previous 12 months.
9. Indemnification
Clients agree to indemnify and hold harmless Selcor LLC, its officers, and employees from any claims, damages, or expenses arising from:
Unauthorized use of the Service
Violations of these Terms
Messaging to unconsented contacts
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law principles.
Any disputes shall be resolved in the state or federal courts located in Pulaski County, Arkansas.
11. Modifications
Selcor reserves the right to modify these Terms at any time.
Updates will be posted at https://selcorllc.com/selcorsms/terms with a new effective date.
Continued use after such updates constitutes acceptance.
